Regarding the Homeswest properties at Buckland Hill, I ask -
(1) Can you confirm whether tenants who moved into the properties in Buckland Hill in 1990 were given an undertaking from Homeswest that they could purchase their properties after ten years?
(2) If not, what undertaking were they given?

(1) No undertaking was given to tenants occupying Buckland Hill properties regarding the purchase of units. The properties at Buckland Hill were built on two ‘super lots’ and are not individually titled. The matter is further complicated by the fact that internal roads are owned by the Department of Housing and Works and are not vested with the local authority. The Department has investigated the possibility of individually titling the units and vesting the internal roads, however, the cost was estimated at that time to be in excess of $400,00 and was considered excessive. The purchase agreement entered into for the site at Buckland Hill required the Department to utilise the site for rental housing for a period of 10 years from the completion of construction. As construction was completed in 1990, the Department would have been able to sell the units from 2000 onwards. However, any enquiries regarding the possible sale after 2000 would have been on the basis that they were individually titled and thus capable of being sold. The Department’s position is that it wants to retain this accommodation as long term public rental housing. (2) No specific undertaking was given, however, the Department of Housing and Works does have a rental sales scheme, which allows any tenant to make application to purchase their property. Agreement to sell a property will only be made where all the Department’s conditions are met. These conditions include that the property has its own title and the Department is willing to sell. The Department is generally reluctant to sell a property where its presence is low and demand for rental accommodation is high for that area. The Department will facilitate a transfer to a suitable property in another area for any of the tenants that wish to enter into home ownership and currently occupy a property the Department wishes to retain.
