FINES ENFORCEMENT REGISTRY
(1) Which act, and section thereof, creates an obligation on the Fines Enforcement Registry to ensure address details of motorists are correct prior to cancelling licences for non-payment of fines? (2) Is there a lawful obligation for motorists to ensure their current address is known by the relevant licensing authority? Rather, the Fines Enforcement Registry relies on information provided from the prosecuting authority provided directly from the offender or the database of licences managed by the director general, Department for Planning and Infrastructure. The reference is section 5 of the Fines, Penalties and Infringement Notices Enforcement Act 1994. (2)-(3) Yes. Regulation 16 of the Road Traffic (Drivers’ Licences) Regulations requires drivers to change their address.
