(1) The Department of Education, having looked into the matter further, has advised that data on "actual assaults" is not readily available. The phrase "actual assault" has no precise legal meaning and the fact of an assault is often defined only by the outcome of legal proceedings. There is no database which records the outcome of these cases which are ultimately determined by the courts.
