(1) State Agreements are facilitating documents designed to assist with the development of major projects. The State monitors

compliance. Ongoing management and reporting against specific obligations during the operational phase of the project are managed through a computerised database system in the Department of State Development.
(2) Pilbara Iron is not a party to a State Agreement. However, Hamersley Iron, the proponent of the Iron Ore (HamersleyRange) Agreement, is obliged to provide power, water and sewerage services within the town boundaries of Tom Price and Paraburdoo under approved proposals.
(3) There are no specific requirements addressing "continuity of services". However, Hamersley Iron is obliged to provide a reasonable level of essential service for operations as approved from time to time under project proposals or until the towns are normalised or the Agreement is determined.
(4) There are no specific provisions in the Hamersley Range State Agreement or approved proposals which require the company to increase capacity to support a growing town.
(5a) There are no active negotiations underway to vary the Hamersley Range State Agreement.
(5b) Whenever Agreement proponents and the Government enter into negotiations to vary the Agreements an opportunity arises to consider a range of matters and local government rating is likely to be one of these issues.
