House representing the Premier:
I refer to the following comments
contained in document 309 of the Lotterywest freedom of information, reference
20/1862, from Peter Klinken to Susan Hunt —
'Thanks for sending that to
us Susan. I think that it looks good and have only one suggested amendment to
Paragraph 4 of your letter ie to remove the first sentence and shorten the
second sentence.'
And this comment from Miriam Borthwick to Susan Hunt —
'Have we run it past our
lawyers?
Do we actually say on any of the
grant documents and application processes that an application must demonstrate
a commitment to diversity or that we have our own commitment to diversity'
(1) Why was the sentence, ''The Lotterywest
board unanimously agreed not to support the request on the basis that
your publicly stated beliefs as founder and chair of the organisation do not
align to this commitment'', removed on the recommendation of the chair
of Lotterywest?
(2) Was the letter run past the
lawyers of Lotterywest prior to its delivery?
(3) If yes to (2), did they express
any concerns; and, if so, what were those concerns?

recommend that this sentence be removed.
(2) Yes.
(3) Lotterywest's
lawyer advised that the Lotterywest board has discretion in relation to the
organisation and the purposes of funding as per section 24 of the Lotteries
Commission Act 1990, and that grant funding conditions could be more explicit.
