(1) Can the minister confirm that - (a) the Yawuru Aboriginal Corporation is currently being denied a perpetual lease over Dampier locations 81 and 141 which it currently leases until 24 May 2006; and (b) the Department for Planning and Infrastructure is proposing to grant freehold title over Dampier location 324 (reserve 1517) to the Yardoogarra Aboriginal Corporation? (2) Can the minister advise why, in these circumstances, one Aboriginal corporation can get freehold title to crown land and another cannot even get a perpetual lease? Hon ADELE FARINA

I thank the member for some notice of this question. (1) (a) The Yawuru Aboriginal Corporation has never been denied a perpetual lease over Dampier locations 81 and 141. (b) It is not proposed to grant freehold title to the Yardoogarra Aboriginal Corporation over Dampier location 324. (2) The granting of tenure must consider a number of factors independent of to whom land is to be granted. The responses to the previous question clearly indicate the state’s position and circumstances and must recognise Aboriginal concerns when dealing with land grants.
