I refer to the Office of the Environmental Protection Authority and ask: (a) how many non-compliances of offset conditions were there in 2008–2009, 2009–2010, 2010–2011 and 2011–2012 and up until December 2013; (b) which entities were found to be non-compliant regarding offset conditions; and (c) what action ensued?

The Office of the Environmental Protection Authority was formed on 27 November 2009.
(a)
2008-09: Not applicable
2009-10: 0
2010-11: 0
2011-12: 1
Up to December 2013: 1
(b) BGC (Australia) Pty Ltd; and LandCorp.
(c) Neither of the non-compliances was considered to have had a significant effect on the environment. In each case a Notice of Non-Compliance was issued to the proponent. The companies have taken appropriate actions to address the non-compliance.
