I refer the minister’s answer to question on notice No 121, dated 16 October 2002, concerning the status of the dusky whaler shark and measures to control the take outside the managed shark fisheries, in which it was confirmed that the dusky whaler population is probably in decline and that the largest source of unmanaged mortality is droplining by the rock lobster fleet and the take from long lines in the commonwealth-managed southern and western tuna and billfish fisheries. Why are the proposed management measures not being directed at eliminating the major sources of unmanaged mortality? Hon KIM CHANCE

Hon KIM CHANCE: As I indicated in the latter part of my answer to question No 121, efforts are already being directed at addressing the take of large dusky whaler sharks from fisheries outside the recognised shark fisheries. Regulation 56A of the Fish Resources Management Regulations, which will prohibit the attachment of hooks to rock lobster pots and some similar unusual fishing methods, will be gazetted on Friday, 29 November 2002. The Department of Fisheries is also proposing measures to protect the breeding stock by prohibiting the take of all dusky whaler sharks over 1.5 metres. The department is undertaking research aimed at finding a simple means of measuring shark trunks to determine from what size shark they are sourced. I have written to the federal Minister for Fisheries, Forestry and Conservation, Senator Ian MacDonald, requesting that the Commonwealth take action to reduce the take of dusky whaler sharks by commonwealth southern and western tuna and billfish fishing licence holders.
