The Public Sector Commissioner is an independent officer. The functions and powers of the Commissioner are outlined in Part 3A of the Public Sector Management Act 1994.
While the Minister may direct the Public Sector Commissioner to undertake a review of a public sector function or body through the operation of 24B (2) of the Public Sector Management Act 1994, no such direction was made in relation to the Department of Training and Workforce Development. The question has been forwarded to the Public Sector Commissioner who has provided the following response.
Statement from the Public Sector Commissioner:
After becoming aware in December 2010 of some working relationship issues between the
Department of Training and Workforce Development and the office of the then Minister for
Training and Workforce Development, I suggested that the communication agreement and associated systems and procedures in the Minister's office be reviewed, and relevant induction and training programs be undertaken. Separately, and following that, I initiated a review by one of my senior officers into the function, structure and operations of the Department of Training and Workforce Development to assure myself that the structural alignment, operational effectiveness, responsiveness and flexibility being sought through the creation of the Department were being achieved.
A draft report was prepared as advice to me that observed that the issues that had arisen between DTWD and the responsible Minister's office were understandable in the context of the establishment of a new organisation. After considering this advice, I deemed it appropriate to allow some time to observe whether the consolidation noted in the report and the outcomes of other actions already mentioned would continue. This time has now passed and I am currently arranging for the report to be finalised. The report will note that;
? the structure and strategic direction for the Department was appropriate
« the consolidation phase for new structural arrangements was essentially complete
? improvements to communication systems and processes aimed at ensuring a productive and effective working relationship were successful and had been sustained.
I do not intend to table the report in Parliament. It is appropriate for me as the Public Sector
Commissioner and employer of departmental CEOs to be able to address any issues that occasionally arise between CEOs and a Minister's office.
