In relation to recommendations made by the Western Australian Local Government Association regarding improvements needed to legislation and policy within the Minister's portfolio of local government, I ask:
(a) does the Minister support a comprehensive review of the
Local Government Act 1995
being undertaken to restore the Act to the principle of general competence, and
(i) if so, when;
(ii) if not, why not;
(b) does the Minister support the
Local Government Act 1995
being amended to remove the rate exemption for Independent Living Units, and to provide clarification on rating of land used for charitable purposes;
(c) does the Minister support that Section 6.21 of the
Local Government Act 1995
be amended to allow Local Governments to use freehold land, in addition to its general fund, as security when borrowing;
(d) does the Minister support that the
Local Government Act 1995
and regulations be amended to enable Local Governments to establish regional subsidiaries as intended by the Local Government Amendment (Regional Subsidiaries) Bill 2010;
(i) if so, when;
(ii) if not, why not; and
(e) does the Minister support that the
Local Government Act 1995
and regulations be amended to enable Local Governments to establish council controlled organisations?
