In March 2002 the Shire of Chittering resolved to initiate a town planning scheme amendment for the development of the Chicken Litter Fired Power Station, subject to a number of points including that the proponent should seek all environmental clearances. On this advice the proponents proceeded to spend some $850 000 in carrying out preliminary studies relating to the proposed site, including the completion of a comprehensive environmental review. The Environmental clearances were duly obtained from the Environmental Protection Authority. However notwithstanding Council's previous resolution in 2002 to initiate the amendment, in September 2003 Council refused to initiate the town planning scheme amendment. The Minister required the Council to initiate the town planning scheme amendment as the Minister considered that the proponents had spent hundreds of thousands of dollars on the project and the Minister did not believe that the Council could unilaterally abandon its undertaking.
