YOUTH AND ADULT DETENTION — GENDER DIVERSE
OR INTERSEX DETAINEES
1163. Hon NICK GOIRAN to the minister representing the
Minister for Corrective Services:
I refer to the 2024–25
budget estimates hearings.
(1) Is the minister aware that during the hearing on
25 June 2024, the committee was informed that one gender diverse or
intersex individual was detained with a biological female in youth detention?
(2) Is the
minister aware that a subsequent answer to additional questions declined to
provide the same information for adult prisoners on the basis that this was
sensitive personal information?
(3) On what basis
was the decision made that such de-identified information on adult prisoners is
considered sensitive personal information, when that information had already
been provided for the far smaller and more vulnerable cohort of youth
prisoners?
(4) Will the
minister now confirm how many assigned males at birth are being detained with
assigned females at birth, irrespective of whether they are adults or
juveniles?
(5) If no to (4),
will the minister undertake to comply with section 82 of the Financial
Management Act 2006 so that the Auditor General may investigate?
