I refer to the October 2008 report, on the release of personal licensing information to Wilson Parking, and I ask -
(1) Can the Minister advise which of the 34 recommendations of this report have been implemented, -
(a) in full; or
(b) partially?
(2) For each recommendation not implemented in full, can the Minister advise why the recommendation has not been implemented?
(3) Has the Department of Transport addressed confidentiality issues with Wilson Parking, to obtain the greatest level of confidence that the information provided will remain confidential?
(4) If yes to (3), -
(a) is the agreement in writing; and
(b) will the Minister table a copy of the agreement?

(a) Recommendations 3, 5, 7, 8, 9, 10, 13, 14, 15, 18, 19, 20, 21, 22, 23, 24, 25, 26, 28, 29, 30, 31, 32, 33, 34. (25 fully implemented).
(b) Recommendations 1, 2, 4, 6, 11, 12, 16, 17, 27. (9 partially implemented).

Recommendation 1
The proposed legislation (
Road Traffic (Administration) Act 2008
) has not been proclaimed due to outstanding dependent legislation. Consequently a decision has been made to progress a separate amendment to the
Road Traffic Act 1974
to address the recommendations in the report. Draft legislation is currently being progressed with the intention to introduce it to Parliament later this year.
Recommendation 2
This recommendation is dependent on Recommendation 1.
Recommendation 4
Policies and procedures have partially been implemented however cannot be finalised until legislative amendments have been implemented in accordance with Recommendation 1.
Recommendation 6
Amendments to Job Description Forms to deal specifically with duties, responsibilities and accountabilities of staff will be completed following roll in to Shared Services. However, the Department of Transport has tightened processes and procedures to deal with vehicle register search functions. Furthermore, structural changes being made to the Driver and Vehicle Services Unit will further strengthen the governance arrangements within the Department of Transport.
Recommendation 11
This recommendation has been partially implemented by the Department of Transport which is currently waiting on information technology system changes to fully implement this recommendation.
Recommendation 12
This recommendation has been implemented operationally, however, the supporting procedural documents are in final stages of completion.
Recommendation 16
This recommendation is dependent on Recommendation 1.
Recommendation 17
This recommendation is being progressed, requiring further system changes to be implemented within TRELIS.
Recommendation 27
This recommendation is being progressed as part of the new governance structures being established in the Department of Transport.
(3) The release of information is by order of the Supreme Court of Western Australia which contains no requirement for an agreement between the parties. Wilson Parking has advised the Department of Transport in writing that it will treat the information received in strictest confidence and will not use it for any other purpose than to identify the driver of the vehicle on the dates the relevant parking breach notices were issued, and to pursue liquidated damages for breaches from these drivers.
