I refer to question without notice 459 from 26 June 2012, on
analysis of submissions on the proposed amendments to the Aboriginal Heritage
Act 1972.
(1) Has the report by Dr John Avery been completed?
(2) If no to (1), at what stage is the report up to and when
will it be completed?
(3) If yes to (1), has the Department of Aboriginal Affairs
released the report?
(4) If no to (3), when will the report be released?
(5) If yes to (3), where can the report be accessed?

(1) Dr John
Avery was not engaged to provide a final written report for publication but to
provide ongoing advice to the state government about how it can improve its
administration of the Aboriginal Heritage Act 1972.
(2) The
Department of Aboriginal Affairs has analysed all submissions received
following the publication of Dr Avery's discussion paper on seven
proposals for change. The submissions have informed the advice and
recommendations to gove rnment about how
the legislation could be amended to improve protection and compliance.
