I refer to the box of documents that has surfaced which contains a map drawn by Don Hancock of the office that Peter Mickelberg was assaulted in and which also indicates the exact positions that Hancock, Lewandowski and Mickelberg were in when then Detective Sergeant Kucera supposedly walked into the room with some hamburgers. Further, I refer to revelations that this map was stapled to a draft affidavit containing evidence put forward by then Assistant Commissioner Bob Kucera, which gave rise to the implication that the assistant commissioner might have been coached in his evidence by Hancock. Given that the Attorney General has received significant notice of this question - Mr J.A. McGinty : I have received no notice of this question - none whatsoever. Mr M.J. BIRNEY : - will he table the map of the same office which was tendered in evidence on 8 May 1998 by then Assistant Commissioner Bob Kucera and which was recorded by the Court of Criminal Appeal as document exhibit 7, appellant 1, sketch of Belmont CIB office by witness Kucera, so that we can see whether it is the same as the one drawn by Don Hancock? The request for the Attorney General to table the map put forward by Assistant Commissioner Kucera was made two days ago. Mr J.A. McGINTY

I have received no notice of the question that the Leader of the Opposition has just put to me. In any event, exhibits that are tendered before the Supreme Court in a trial remain the property of that court. They are not my property. I am not in a position to table them because I simply do not have them. When Mr Lewandowski was alive, he was crystal clear on this issue. It would do the opposition well to reflect on this, particularly the interview by Alison Fan from Channel Seven with Tony Lewandowski, which is an interview that I believe all members in this place will remember well. I will quote briefly from it. Alison Fan says - Tony Lewandowski says he and Don Hancock were the only ones who knew about the fabricated confessions. Mr M.J. Birney : What does Tony Lewandowski’s mother say? Mr J.A. McGINTY : The Leader of the Opposition does not like the truth. Several opposition members interjected. The SPEAKER : Order, members! I call the Leader of the Opposition to order for the second time. Mr J.A. McGINTY : What did Tony Lewandowski say about this matter when he was alive? I will read what was said straight from the horse’s mouth - No-one else had any involvement or knowledge of what we did. That is the transcript of Tony Lewandowski’s interview with Alison Fan on Channel Seven News. Mr M.J. Birney interjected. Mr J.A. McGINTY : I do not think that the Leader of the Opposition has to do much better at all. When Tony Lewandowski, a disgraced former Western Australian detective, was alive, he made the factual position quite clear in the extract to which I just referred.
