Elder abuse—Legislation
531. Hon Nick Goiran to
the parliamentary secretary representing the Attorney
General:
I refer to World
Elder Abuse Awareness Day, which was recognised yesterday, 15 June 2026.
(1) Is the Attorney General aware that
the January 2017 election manifesto from WA Labor on responding to elder abuse
promised to expedite amendments to the law surrounding enduring powers of
attorney and guardianship?
(2) Is the Attorney General aware that,
following no such action, the Select Committee into Elder Abuse in its final
report of September 2018 called on the government to act as a matter of
urgency?
(3) With no such bill having been
introduced into either the fortieth or the forty-first Parliaments, will the
Attorney General commit to doing so this calendar year?

I thank the Leader
of the Opposition for some notice of the question.
(1) Yes.
(2) The government commissioned the Law
Reform Commission of Western Australia to undertake a comprehensive review of
the Guardianship and Administration Act 1990 .
The resulting report, Project 114 Guardianship and
Administration Act 1990 (WA) Final Report , was tabled in Parliament by
the Attorney General on 26 February 2026. The government established the WA
Strategy to Respond to the Abuse of Older People in 2019, and is implementing
its recommendations through the 2022–2027 action plan. The government is also
investing in services, including legal support, advocacy and the Elder Abuse
Helpline, so that older Western Australians can now access support.
(3) The government is carefully
considering the Law Reform Commission of Western Australia's recommendations in Project 114 and is committed to legislative reforms that are
well-informed and effective, and that deliver strong protections for vulnerable
Western Australians.
