CONGLOMERATE HOTEL, NULLAGINE
I understand that the police at Nullagine closed the Conglomerate Hotel with little or no warning at 10.00 am on Friday, 12 April 2002 as there was to be a funeral in the town at 3.00 pm on the following Saturday. I also understand that the hotel was not permitted to reopen until 11.00 am on the Sunday. Will the minister advise - (1) Did the police give consideration to the loss of earnings to the owner or licensee during the period the hotel was closed? (2) If not, why not? (3) Why was the licensee not given adequate warning that the hotel would be closed during that period? Hon N.D. GRIFFITHS

(1) The Western Australia Police Service advises that it did take into consideration the loss of earnings by the licensee. However, as a result of information received, there were fears that friction between families attending from Nullagine and Marble Bar would result in unrest and that the supply of alcohol would escalate the likelihood of that unrest. In the interests of maintaining the peace, section 114(1) of the Liquor Licensing Act 1988 was applied to suspend trading at the hotel until the funeral and subsequent wake had concluded. As a result of this action, the funeral took place without major incident. (2) Not applicable. (3) The Western Australia Police Service notified the licensee on the same day it was informed of the funeral arrangements.
