Environmental Protection Act 1986
licence dated June 13 2005 addressed to the Manager, Kanowna Belle Gold Mines -
(1) Can the Minister explain how does the arsenic (As) level of the groundwater samples taken affect or potentially affect hypersaline groundwater given that arsenic occurs naturally and the hypersaline groundwater can be argued to be of no beneficial use except for mineral processing?
(2) If no to (2), why not?
(3) Is it correct that condition W10 under the heading ‘Site Drainage Requirements’ states ‘The Licensee shall ensure that the premises is drained such that contaminated stormwater is retained on the premises’?
(4) If no to (1), will the Minister quote the specific text of the condition?
(5) Can the Minister explain what is the specific purpose of condition W10 to require that contaminated stormwater be drained such that contaminated stormwater be retained on the premises?
(6) If no to (5), why not?
(7) Can the Minister explain why the licensee is required under condition W14(a) to protect on a mining tenement the surrounding soils and groundwater which is hypersaline and can be argued to be of no beneficial use except as mineral processing?
(8) If no to (6), why not?
(9) Is it correct that condition S1 states ‘The licensee shall ensure that the depleted waste bags stored in an enclosed area are disposed of at a Class V landfill facility’?
(10) If no to (9), will the Minister quote the specific text of the condition?
(11) Can the Minister state the name and location of the Class V landfill facility that these depleted waste bags have been disposed at?
(12) If no to (11), why not?
(13) Can the Minister state how many times in the last six years the licensee has breached any licence conditions whether prosecuted or not, the specific licence condition that was breached and what specific enforcement action, if any, that followed?

The Minister for the Environment; Science has provided the following response: (1) No. (2) Kanowna Belle are required to monitor water levels, pH, Total Dissolved Solids (TDS), Weak Acid Dissociable Cyanide (WADCN) and Arsenic (As) from eleven bores around their tailings storage facility. These parameters have been selected, based on an assessment of local conditions, as important indicators of seepage from the facility. (3) Yes (4) Not applicable (5) Yes. The purpose of the condition was to ensure that contaminated surface water was appropriately managed on site. Uncontrolled contaminated stormwater release can impact on vegetation. (6) Not applicable. (7) Yes. Condition W14(a) is to ensure that waste oils and other hydrocarbon waste matter is contained so that it does not impact on vegetation in the surrounding area. (8) Not applicable. (9) Yes. (10) Not applicable. (11) Kanowna Belle have disposed of this material to the Mt Walton Class V Intractable Waste Disposal Facility, located at Mt Walton about 120km north west of Coolgardie. (12) Not applicable.
