refer the minister to a recent talkback segment on ABC radio's morning
show, which aired on 18 November 2024, in
which a caller claimed that 98 per cent of development assessment panel
decisions found in favour of developers . Never one to trust an
unverified source, I wanted to give the minister an opportunity to rebut that
claim, so I ask the following question.
Can the minister please provide a breakdown,
from the most recent data available to him, of the percentage of DAP cases that
have been resolved in favour of the developer as opposed to those that have
upheld a local government decision?

of the question. I provide the following response on behalf of the Minister for
Planning as the Minister for Agriculture and Food is out of the chamber on
urgent parliamentary business.
It is unclear what media the member
is referring to. A development assessment panel stands in the shoes of the
relevant local government and makes a decision based on the requirements and
level of discretion set out in the local government's local planning
scheme. A DAP has no more discretion available to it than the local government would if it were the decision-maker. The role of
the local government in the DAP process is to undertake the planning assessment, including public consultation, and then provide a recommendation to
the DAP. The local government does not make a decision.
