(1) Is the Public Sector Standards Commissioner investigating a complaint in the Ministry of Justice concerning the acceptance of a late application for a position in the Ministry of Justice?
(2) If so, has the complaint been investigated?
(3) Has the Commissioner or his office made any findings in relation to the complaint?
(4) Have those findings been published?
(5) Will they be published?
(6) If not why not?
(7) Has the investigation been completed?
(8) If not, why not?
(9) What has been the delay in completing the investigation?
(10) Will the Parliament be provided with a copy of the report of the investigation?

The Minister Replied:
The Commissioner for Public Sector Standards advises:
(1) Yes
(2) The allegation is under investigation
(3) No
(4) No
(5) If a breach is established, the Commissioner may elect to report the outcome to the Minister for Justice and Parliament.
(6) The Commissioner only reports findings of an investigation where he establishes that a breach has occurred.
(7) No
(8) The Commissioner is considering information obtained from the Ministry of Justice.
(9) There has been no delay in finalising the investigation.
(10) In accordance with s.21 of the Public Sector Management Act 1994, the Commissioner for Public Sector Standards may provide a report to the relevant Minister and/or both Houses of Parliament where a breach is established.
(11) The Commissioner for Public Sector Standards has not, as yet, established a breach.
