(1) The WA Industrial Relations Commission (WAIRC) issued orders on 23 September 2010 terminating bargaining between the negotiating parties. Prior to this date there had been no formal Government offer made to Perth train drivers. The Arbitration proceed commenced on 1 December 2010. The matter is currently before the WAIRC for decision.
(2) No. No formal offer has been made to the drivers, and the drivers did not accept the EBA offer in 2008 therefore this question is hypothetical.
(3) No. The drivers have now had the opportunity to put the merits of their case to the WA Industrial Relations Commission and a decision is pending.
