I refer to a letter which I understand is dated April 30 2003, signed by Wayne Astill for Michelle Andrews, Acting Director, Environmental Regulation Division addressed to Mr John Shipp, Registered Manager, Kalgoorlie Consolidated Gold Mines(KCGM) titled ‘Re: Annual Environmental Report 2002- Licence No. 6420’ and the KCGM seepage and groundwater management plan dated September 29 2005 -
(1) Will the Minister table the letter dated April 30 2003?
(2) If no to (1), why not?
(3) Can the Minister explain why the Department of Environment wrote stating ‘Depth to groundwater lowered to more than six metres due to increased pumping rates? It is noted you have instigated a management plan to stabilise the groundwater levels by recovering groundwater within permeable layers in the ground that usually occur at 10-20mbgl’?
(4) If no to (3), why not?
(5) Can the Minister specifically state and identify what precisely is different from the ‘management plan’ identified/referred in the letter dated April 30 2003, and the KCGM seepage and groundwater management plan dated September 29 2005?
(6) If no to (5), why not?
(7) Can the Minister state what was the penalty for breaching any licence conditions on licence number 6420 at Fimiston or the Gidgi Licence in the years -
(a) 2001;
(b) 2002; and
(c) 2003?
(8) If no to (7), why not?
(9) Can the Minister explain why the Department of Environment wrote stating ‘There appears to be no bunding of pipes in the photographic evidence provided for Fimiston and Gidgi vegetation monitoring program (App 9.11 and 9.12) i.e. E1, F1, H2 (Fim) and MBR5(Gidgi)’?
(10) If no to (9), why not?
(11) Did KCGM breach licence conditions at either Gidgi and Fimiston operations which basically required bunding of pipelines containing saline, alkaline or cyanide constituents which included but was not limited to tailings delivery lines, return water lines and saline water lines?
(12) If yes to (11), why?
(13) If no to (11), why not?
(14) Can the Minister specifically state and identify what is similar or the same with the management plan identified/referred in the letter dated April 30 2003, and the KCGM seepage and groundwater management plan dated September 29 2005?
(15) If no to (14), why not?

The Minister for the Environment; Science has provided the following response: The following information is correct as at 13 December 2005. (1) Yes. (See tabled paper no ). (2) Not applicable. (3) KCGM in their Annual Environmental Report for 2002 showed that groundwater level trends were stabilising by pumping groundwater from permeable zones that occurred at 10 to 20m below ground levels. The officers of the DoE who reviewed the annual environmental report noted this action. (4) Not applicable. (5) The management plan in the Annual Environmental Report for 2002 was a voluntary plan by KCGM aiming at stabilising groundwater levels. Conversely the implementation of the Seepage and Groundwater Management plan is a condition of license 6420/10 and will be an ongoing plan with objectives and framework as outlined in Question on Notice 2885 - questions (1) & (5). (6) Not applicable. (7) The maximum penalty for contravention of a licence condition for a body corporate was (a) $125,000 and $25,000 per day in 2001; (b) $125,000 and $25,000 per day in 2002; and (c) $125,000 and $25,000 per day in 2003. (8) Not applicable. (9) The officer assessing the Annual Environmental Report of 2002 prepared by KCGM did not identify bunding around these pipelines. (10) Not applicable. (11) No. (12) Not applicable. (13) Further examination of the photos shows that bunding was visible in these areas. This was confirmed on 13 August 2003 during a site inspection of both premises where pipeline bunding was identified as compliant with licence conditions. (14) The management plan noted in 2003 was a voluntary plan by KCGM to stabilise groundwater levels, with a internal management target for groundwater levels of 4m and 6m below ground level. These internal management targets have been formalised in the Seepage and Groundwater Management plan amongst a range of other objectives and frameworks as outlined in Question on Notice 2885 - questions (1) & (5).
