With regard to the Shire of Wyndham East Kimberley (SWEK), I ask -
(1) Can the Minister for Planning and Infrastructure detail the reasons leading to the decision by SWEK to make decisions inconsistent with the Kununurra Town Planning Scheme (TPS) No. 7 with regards to illegal roads, tracks and signage/advertising by Lakeside Resort on Proposed Special Foreshore Reserve 41812 extension?
(2) How many times since the TPS No. 7 was endorsed has SWEK approved planning proposals inconsistent with TPS No. 7, that have rendered the approvals void?
(3) Will the Minister provide details of those developments that are void in (2)?
(4) Given that the illegal landclearing carried out by Darren Spackman on Reserves 41812 and 715 contravenes the
Land Administration Act 1997
, what action will the Department for Planning and Infrastructure (DPI) (previously Department of Land Administration (DOLA)) take to ensure that the area is rehabilitated?
(5) Can the Minister detail the reasons why the Kununurra Office of Land Asset Management Services (DPI) had knowledge of and allowed Darren Spackman to carry out illegal landclearing within a Ramsar site boundary and within a registered Aboriginal Heritage Site and without -
(a) sighting any development proposals; and
(b) without any required permits being obtained by the proponents?
(6) Has DPI provided support to proponents for illegal developments on Reserves 41812 and 715 (Darren Spackman) to preempt development on those reserves?
(7) Can the Minister detail the reasons why DPI has ignored its obligations under the Ord River Waterways Management Group Memorandum of Understanding and gone against statutory legislation under the
Aboriginal Heritage Act
1972
, by allowing illegal landclearing on proposed Reserve 41812 extension and 715 by Darren Spackman without the appropriate heritage clearances?
(8) Has SWEK developed a lease for Darren Spackman on part of Reserves 41812 and 715 outside of due process and without the approval of management authorities in the Department of Environment and Land Asset Services (DPI)?
