(1) I refer to the application for an asphalt manufacturing plant in Orange Grove by Boral Resources and ask what is the zoning of the area for the plant? (2) What aspects of "Development Control Policy 5.3 - Use of Land Reserved
for Parks and Recreation and Regional Open Space" are inconsistent with the operation of an asphalt processing plant? (3) Does the plant fit within the amenity of a rural residential environment? (4) How is the buffer zone calculated? (5) Has the contractor or proponent incorrectly calculated the buffer zone and, if so, how will this be corrected? (6) What period of time has the proponent sought approval for operation of the plant? (7) What is the expected increase in truck movements in and out of the plant: (a) per annum; and (b) for the life of the proposed plant? (8) What pollutants would be emitted from the plant? (9) Will the Government require independent monitoring of pollutants? (10) When will the Western Australian Planning Commission make a determination on the application?

(1) The asphalt plant is proposed to be located on a portion of Lot 467 Stephen Street, Orange Grove which is reserved 'Parks and Recreation' under the Metropolitan Region Scheme.

Development Control Policy 5.3 - Use of Land Reserved for Parks and Recreation and Regional Open Space
provides guidance on the Western Australian Planning Commission's consideration of applications for land reserved for Parks and Recreation. While the intent of this policy is to preserve land for recreational or conservation purposes, there are a range of other factors, policies and strategic documents that must be taken into account. Additional guidance on development assessment requirements and the matters to be taken into account are outlined in
Development Control Policy 1.2 - Development Control - General Principles

(3) The Western Australian Planning Commission considered that the conditional approval of the temporary mobile asphalt plant would not have a significant effect on the existing amenity of the area, which is in the vicinity of longstanding hard rock quarries.
(4) The Department of Environment Regulation (DER) has advised that the Environmental Protection Authority's Guidance Statement No. 3 "Separation Distances Between Industrial and Sensitive Land Uses" sets default separation distances to minimise impacts from emissions. The DER recommends that the separation distances specified in the Guidance Statement be maintained.
(5) The Department of Environment Regulation recommends that the separation distances specified in the Guidance Statement be maintained.
(6) Three years.
(7) Supporting documentation submitted by Boral indicates that, based on the amount of product to be transported, the additional truck movements (return trips) are estimated to be:
(a) 722
(b) 1805
(8-9) The Department of Environment Regulation has advised that should the works application be approved, the decision to include ambient monitoring conditions will be determined once commissioning has been completed and commissioning monitoring data has been reviewed. In the event of an approval, the occupier will be expected to manage potential odour and dust emissions under respective management plans which are implemented through conditions of the licence.
(10) I am advised that the Western Australian Planning Commission granted conditional approval of the application on 31 March 2014.
I am advised the conditions are as follows:
That the Western Australian Planning Commission resolves to approve a temporary Mobile Asphalt Plant at Lot 467 Stephen Street, Orange Grove subject to the following conditions:
1. The development hereby granted is for a limited period of 3 years, after which the development is to be removed and the site reinstated;
2. The Mobile Asphalt Plant shall not be operated outside the hours of 5am to 5pm weekdays or 5am to 4pm Saturdays; and
3. No cartage of asphalt from the site shall occur outside the hours of 6am to 6pm weekdays or 6am to 4pm Saturdays.
