The Minister for Industry and Enterprise has provided the following response:
a) No. As the Member is aware I sent to an informative memo to TIAC members in January this year regarding changes in portfolio responsibilities following the Cabinet reshuffle. In the memo I suggested that TIAC might not need to meet until the review of the ITD Act was complete which at the time I believed was imminent. At no time would I expect TIAC not to meet its obligations under the ITD Act schedule 1, section 8 in regards to meetings.
b) Not applicable. I refer the member to Section 25 of the Industry and Technology Development Act 1998 stating that the Minister may give written directions to the Council. Part 2 states that any such direction will be tabled before Parliament in its annual report. As there was no such direction in the TIAC annual report it is obvious that TIAC did not deem the memo a direction.
I would advise the Member that a new TIAC body has been appointed that has very eminent people on it and is functioning extremely well, the matters that you continue to raise in Questions on Notice refer to the previous committee and I consider the matter closed.
