There are two overlapping claims over the Perth metropolitan area. Attempts over many years to mediate with the two overlapping claimant groups have not met with success. Mediation in 2003 had proceeded on the basis that outcomes outside the native title process were the most fruitful focus of discussion. Both Mr Bodney and the Combined Metropolitan claimants proposed outcomes that the State Government could not reasonably accommodate. Rather than focus on outcomes that may be possible through the mediation process, Mr Bodney decided to proceed with litigation. Mediation was suspended for a number of reasons, including the likelihood that other Noongar people, who are not included in claims brought by either the Combined Metropolitan claimants or Mr Bodney, are also entitled to some recognition for their connection to the region; the difficulties of engaging with the group given that they are not represented in these claims by the Native Title Representative Body for the area; and the difficulties in accommodating their demands. The Federal Court struck out Mr Bodney’s claims on 24 August 2003 due to problems of authorisation and description of claim group. Notwithstanding this, the State Government, through the Office of Native Title, has sought to engage the South West Aboriginal Land and Sea Council which is the Native Title Representative Body for the area under the Native Title Act 1993 (Cth), over a regional approach to native title negotiation that would include the metropolitan area.
