I refer to photographs taken on 21 January 2010, of clearing of vegetation and construction of bores undertaken with exploration equipment available for viewing at www.mp.wa.gov.au/rchapple/Kaltails, a document dated 3 December 2009 titled ‘KCGM Mining Proposal and Works Approval Application’ and an article which appeared in
The Kalgoorlie Miner
newspaper on Friday, 15 January 2010 on page two titled ‘KCGM faces two charges’, -
(1) Can the Minister state the specific date on which with the Department of Mines and Petroleum (DMP) Director of Environment provided written approval for the construction and clearing of vegetation for the monitoring bores depicted as proposed bores on page 44 of the document dated 3 December 2009?
(2) If no to (1), why not?
(3) If yes to (1), will the Minister table a copy of that written approval?
(4) Has KCGM employees/contractors breached any tenement conditions on General Purpose leases 26/165, 26/166, Prospecting Licence 26/2373 and other tenements in constructing monitoring bores and clearing vegetation in the immediate vicinity of these bores?
(5) If no to (4), why not?
(6) If yes to (4), will the DMP initiate forfeiture action and impose a high penalty on the tenement holders?
(7) Is it correct that KCGM was fined over $57 000 by the Minister for Mines in 1995 for not adhering to tenement condition in failing to obtain the prior written permission of the State Mining Engineer with the construction and clearing of the Fimiston 2 tailings dam?
(8) If yes to (7), will the history of KCGM as an offender in breaching tenement conditions be taken into consideration on imposing any penalty for any recent alleged breaches?
(9) If no (7), what specifically is correct and will the history of KCGM as a offender in breaching tenement conditions be taken into consideration on imposing any penalty for any recent alleged breaches?
(10) Has KCGM complied with all tenement conditions on G26/165, 26/166, G 26/143, G26/144, G26/99 – G 26/107, prospecting licences 26/2790 and 26/2373?
(11) If no to (10), -
(a) why not; and
(b) which specific conditions have not been complied with?

1) Questions 1), 2), 3), 4), 5), 6), 8), 9), 10) and 11) relate to allegations of non-compliance against the Kalgoorlie Consolidated Gold Mines (KCGM), and the potential action that will be taken in response to any such non-compliance.
These allegations are the subject of an ongoing investigation which has been initiated by the Department of Mines and Petroleum. Once the investigation is finalised and, if it is verified that a breach of tenement has occurred, the circumstances of the case will be considered and penalties, allowed for under the Mining Act 1978, may be applied to the tenement holders.

7) On 1 June 1995, the then Minister for Mines imposed fines totalling $57,500 on tenements managed by KCGM for breach of conditions of various mining and general purpose leases.
