(a) why was the original tender process to construct a new Pathcentre abandoned;
(b) when will the process re-commence;
(c) when will tenders close;
(d) when will a contract be awarded to the successful tenderer;
(e) what is the total budgeted amount for the construction of a new Pathcentre building;
(f) who made the decision to abandon the original tender process;
(g) did the Minister endorse that decision and, if so, what were the reasons; and
(h) were any tenderers excluded from the original tender process; and
(i) if so, why; and
(ii) did the Minister endorse that decision?

Department of Treasury and Finance
(a) The Department of Treasury and Finance ruled BGC's tender non-conforming to the advertised tender requirements. BGC obtained an injunction restraining the State from awarding a contract without considering BGC's tender. There remained uncertainty about the conformance of tenders, and about when a contract could be awarded. The decision to reject all tenders was taken to ensure all tenderers were treated equally and fairly, and to enable the process to select a contractor to construct the facility to proceed with certainty.
(b) All tenders were rejected on 4 January 2010. New tenders were requested on
21 January 2010.
(c) Tenders closed on 11 February 2010.
(d) A contract was awarded to BGC Construction on 24 March 2010.
(e) The original project budget was $71,400,000. Due to very competitive tenders being received, the revised budget is $54,400.000.
(f) The Under Treasurer, after taking advice from the State Solicitor's Office and with agreement by the Director General of the Department of Health.
(g) The former Treasurer Hon. Troy Buswell MLA was advised of the decision by the Under Treasurer.
