I refer to the Minister's decision to direct the City of Nedlands to modify its scheme amendment to facilitate developments of greater height and scale along Waratah Avenue Dalkeith, and ask:
(a) for what reason did the Minister make this direction;
(b) did the Minister or his office receive any representations from residents, developers or any other party supporting developments of greater height and scale in Waratah Avenue, and if so, from whom; and
(c) did the Minister discuss this matter with, or have any correspondence with the Member for Bateman regarding this proposal, and if so, on what dates did this communication occur?

(a) In reaching my decision, I gave close consideration to the content of the objections to the proposal, particularly from those who believe that the modified proposal would significantly affect amenity and result in development out of character with the area. However, I was not convinced by the submissions that one additional storey on these sites, in addition to the three storeys currently permitted, would adversely affect the character, or be to the detriment of, the amenity of the area.
I consider that the commercial properties along Waratah Avenue present a suitable location to provide the opportunity for this very limited increase in residential density and housing choice. Further, this is in line with the City of Nedlands draft Local Planning Strategy, which identifies the need to provide for the City's ageing population and attendant changing housing needs. The provision of additional housing choices is also in line with similar goals in
Directions 2031 and Beyond
.
I also note that an independent planning study commissioned by the City of Nedlands Council indicated that a maximum building height of five storeys may be suitable for a number of these sites.
(b) In September 2010 a submission in support of the proposal from the project proponents was noted  by me.
In September 2011 a prospective purchaser of the sites contacted my office regarding timing of the Amendment decision, however the content of the proposal was not discussed in any detail.
During 2011 I received various correspondence from Dalkeith residents supporting increased density and scale of development for the area, although none of these specifically mentioned Amendment 192.
