I refer to a letter which I understand is dated Wednesday, May 15 1991 signed by Peter Browne-Cooper, Director Pollution Control Division from the Environmental Protection Authority addressed to the Manager, Kalgoorlie Consolidated Gold Mines Pty Ltd concerning works approval 652 for the Fimiston Tailings Storage Facility -
(1) Is it correct that part of this letter states ‘This approval allows you to commence construction, however, this does not remove the need for necessary approvals from other authorities. Before the project is brought into operation, your existing

licence must be modified and the Director Pollution Control Division must be satisfied that the requirements of the works approval have been met. You should advise the Authority accordingly, quoting the above reference number, approximately 2 months prior to commissioning the works’?
(2) If no to (1) what specifically does it state?
(3) Can the Minister explain specifically what procedures and process did the Director Pollution Control Division carry out to verify and satisfy himself that all the ‘requirements of the works approval’ and licence conditions had been met?
(4) If no to (3) why not?
(5) Can the Minister quote and state the text of what were all the ‘specific requirements of the works approval’?
(6) If no to (5) why not?
(7) Can the Minister quote the date and specific text of any letters received from KCGM in which the ‘Authority’ was advised ‘accordingly’?

(3) I am informed that the Director required a compliance document from the works approval holder at the completion of works stating that the works have been completed, in accordance with approval conditions. On receipt of the compliance document, the Department of Environmental Protection (DEP) carries out assessment of the compliance document prior to issuing a licence for the new premises or amending a licence for the existing premises. In this case, the Director was satisfied with the compliance letter submitted by KCGM at the completion of works under Works Approval 652 and was of the opinion that all works approval conditions had been met.
