I refer to question on notice No. 398 of March 4 2003 and the answers provided -
(1) Can the Minister explain why it took well over four months from the August 24 2002 till January 15 2003 before the Kalgoorlie Cement Works (KCW) was asked to engage an acoustic consultant given that Mr Right had clearly verbally advised Mr Wayne Astill that the noise was intolerable during the day and was seriously affecting his sleeping patterns after working nightshift?
(2) If no to (1), why not?
(3) Can the Minister state the specific date on which KCW was advised by the DEP to retain stormwater on site?
(4) If no to (3), why not?
(5) Can the Minister state the specific date on which the DEP informed the City of Kalgoorlie-Boulder of the possibility of stormwater run-off from the site and the reasons(s) why this was done?
(6) If no to (5), why not?
(7) Can the Minister state the text of the letter or email that was provided to KCW from the DEP advising them to retain stormwater on site?
(8) If no to (7), why not?

(1) The tape was forwarded to the Department of Environmental Protection’s (DEP) noise lab on 28 August 2002. The analysis was prioritised along with other tasks for the noise lab at that time. The analysis needed to consider other nearby commercial and industrial premises, roads and their respective distances from the complainant. This data was not readily available and required on the ground investigation by departmental staff. In order to try and gauge the severity of the concerns with Kalgoorlie Cement Works (KCW) operations, the DEP has also contacted other adjacent neighbours to KCW. At the time, the three other residents contacted indicated no complaints about the operations at KCW. (2) Answered by (1). (3) Yes, verbal instruction was issued on 6 January 2003. (4) Answered by (3). (5) Yes, the DEP contacted an Environmental Health Officer of the City of Kalgoorlie-Boulder on 6 January 2003. The DEP understood that under the City of Kalgoorlie-Boulder’s by-laws, stormwater runoff must be retained on site or be discharged onto roads. This was confirmed and discussed with the City. (6) Answered by (5). (7) No. (8) A verbal instruction was issued by the DEP on behalf of the City of Kalgoorlie-Boulder and was recorded on file.
