I refer to a meeting held by the Aboriginal Cultural Materials Committee (ACMC) on the 21 November 2012 at which advice from the State Solicitor’s Office (SSO) on section 5(b) of the Aboriginal Heritage Act 1972 (AHA) was endorsed and back dated to 1 November 2012, and ask: (a) was there dissent at that meeting about the endorsement and application of SSO advice on section 5(b) of the AHA; (b) if yes to (a), is it necessary for the ACMC to reach a consensus on the interpretation of the AHA; (c) if no to (b), who has the authority to make decisions such as these; and (d) which members of the ACMC were of the view that SSO advice on section 5(b) of the AHA should be endorsed?
