I refer to the Pastoral Lease Exclusions 2015 document and the specific pastoral leases to which the Shire of Derby-West Kimberley is named as the exclusion proponent -
(1) Is the Minister aware that the Shire of Derby-West Kimberley identified these specific locations at the request of the Department of Land Administration but has made it clear to the Department that the identified land represents no more than a general location area only for certain gorges and that the Shire has stated that these gorge areas will need to be accurately surveyed to identify the actual area required to form the excision?
(2) Is the Minister further aware that the Shire of Derby-West Kimberley has acknowledged that the particular areas of land stipulated in the Pastoral Lease Exclusions document to which the Shire is nominated as the exclusion proponent may represent up to 10 times the area of land actually required to be excised, based on the generality of the identified location rather than the specific area?
(3) Is the Minister further aware that the Shire of Derby-West Kimberley does not have the capacity to accurately survey the proposed excisions and requires advice from DOLA on who is to commission and pay for the survey required to identify the specific land?
(4) Is the Minister further aware that the Shire of Derby-West Kimberley does not wish to be the acquiring authority as it does not have the resources to act as the on-going manager of the land and is awaiting advice from CALM to determine if CALM is prepared to act as the acquiring authority?

(2) - (4) The Minister is aware that the Shire of Derby/West Kimberley has indicated that it does not wish to be the acquiring authority and does not wish to manage the land excluded. An officer from Department of Land Administration (DOLA) met with Shire Officers and Councillors to offer assistance with plan preparation and negotiations with pastoralists in April 2003. The Department for Planning and Infrastructure (DPI) has agreed to undertake exclusion negotiations for proposals identified by the Shire of Derby/West Kimberley. DPI has already commenced some negotiations, which involve in some cases the exclusions identified being negotiated to a lesser area.
