I refer to briefing note reference 89683 signed by the Director General of the Department of Minerals and Energy, Mr Lee Ranford dated September 29 1998 and a attached response reference 89683 for the Minister -
(1) Has the Department of Minerals and Energy provided incorrect and misleading information in preparing the response 89683 for the Minister?
(2) If so, will the Department apologise to the complainant?

(1) The letter to Mr Meyer Forst attached to the briefing note contains two errors. The Minister for State Development has been assured that there was no intention to mislead. The second paragraph of the letter is incorrect in that whilst some old mine workings had been filled in by KCGM elsewhere in the general Williamstown area, the work carried out within 100 metres of Mr Meyer Forst's property on 12 March and 3 April 1998 did not include the filling in of old workings. The last paragraph is incorrect in that the Department's records contain no indication that the Crown Solicitors Office opinion was sought in this case; rather, it is evident from Mr Hopkins' letter of 4 August1998 that he himself had concluded that the matter should not be further pursued. (2) The Minister for State Development will take this matter up with the Department.
