I thank the member for some notice of this question. (1) Under the Rights in Water and Irrigation Exemption and Repeal (Section 26C) Order 2001, water being taken from the water table aquifer is exempt from licensing when that water is being taken for the purposes of - (a) domestic use; (b) the irrigation of up to 0.2 hectares of lawns and gardens - a lawn or garden is not to be watered by use of a sprinkler at any time between the hours of 9.00 am to 6.00 pm; (c) stock watering - other than those being raised under intensive conditions as defined in section 21(4) of the act; and (d) firefighting. This order applies to all parts of the state that are proclaimed areas other than - (a) the Albany ground water area; and (b) that part of the Gascoyne ground water area in the North West Cape north of south latitude 22.5 degrees. When water is taken from a confined aquifer or when the stock is being farmed intensively - not free range - a licence for stock watering is required. (2) When the stock water is licensed, the water entitlement is based on the number of stock being watered, and calculated on the basis of kilolitres per head per annum. (3) The volume of water for stock watering is in addition to water taken from bores on the same property for domestic use.
