representing the Minister for Environment:
I
refer to the state's contract with Western Australia Return Recycle
Renew Ltd—WARRRL—to manage the container deposit scheme.
(1) Was the
original contract with the state government established using a competitive
process?
(2) If yes to
(1), how many other tenders were made at the time?
(3) How much does
the state pay WARRRL for the contract?
(4) Were any
provisions included in the contract with WARRRL to ensure it supported
innovation and competition in the process of container collection?
(5) Does the contract
require WARRRL to provide an annual report on the effectiveness of the scheme
to the state government?
(6) When is the
contract up for renewal?
(7) Will the
state open the contract to competition when the current contract ends?

I thank the member for some notice
of the question. On behalf of the Minister for Environment the answer is as follows.
(1) Yes, the
scheme coordinator was selected through a competitive process.
(2) There were two respondents to
the request for proposal.
(3) Western Australia Return
Recycle Renew Ltd does not receive payment from the state government.
(4) WARRRL was
appointed scheme coordinator under section 47X of the Waste Avoidance and
Resource Recovery Act 2007. Obligations imposed on WARRRL include achieving a high
rate of return for containers and enabling access to the scheme. The conditions
of appointment do not directly deal with innovation and competition in the
process of container collection.
(5) Yes.
Regulation 15 of the Waste Avoidance and Resource Recovery (Container Deposit
Scheme) Regulations 2019 requires the coordinator to give the minister an
annual report about its operations.
(6) The term of appointment
concludes seven years after the appointment day, 20 October 2020.
(7) At the end of
the term of appointment, the Waste Avoidance and Resource Recovery Act 2007
allows the minister to issue a request for proposals or for appointment to be
extended.
