(1) & (2) The Department of Minerals and Energy has received advice from the Crown Solicitor?s Office on the issue of responsibility for abandoned mine workings. That advice is summarised in Attachment ?A?. See tabled paper. In essence, an incident that causes personal injury or damage to property makes all parties who have an interest in or occupation of the land or who have a relevant involvement in mining activity potentially liable in any civil action involving negligence.
