466. Hon NICK GOIRAN to the parliamentary secretary
representing the Attorney General:
I refer to the answer provided on
29 March 2023 to my question without notice 372 in which the house was informed
that the Attorney General is now seeking advice from the State Solicitor's
Office regarding the appeal decision in RE AR [2023] WADC 28, delivered on 17 March
2023, in which His Honour, in upholding the appeal of a victim of sexual
assault, said at 61 —
The assessor's decision and
the process by which it was reached is, to say the least, gravely disquieting.
(1) Has the Attorney General now
received that advice?
(2) Will the
Attorney General now direct that an investigation be commenced into this prima
facie case of collusion to pervert the course of justice within the Office of
Criminal Injuries Compensation?
(3) If no to (2) or (3), why not?

involved, or may have involved, any serious misconduct.
