NICHELIVING
1178. Hon STEVE MARTIN to the Minister for Commerce:
I refer to Nicheliving and the
government's deal not to pursue it financially while taxpayers and
other building customers fund indemnity insurance costs.
(1) What is the
dollar value of Nicheliving's held assets, as must have been determined
by the government ahead of the deal?
(2) Does the
government's deal with Nicheliving preclude it from continuing to
operate as a development business as detailed in Nicheliving's 11 October
press release?
(3) If no to (2), why not?

I thank the honourable member for
some notice of the question.
(1) I do not accept the premise of the question. The
financial position of Projex Management and Construction Pty Ltd's Nicheliving was considered as
part of the Building Services Board's assessment of its registration renewal application. The Building Services (Registration) Act 2011 requires
that information provided to the board for such purposes be kept confidential.
The financial position of the company was the heart of the dispute.
(2)–(3) The
settlement agreement between the state and Nicheliving focused on Nicheliving's
registration as a building contractor and providing certainty and relief for long-suffering
home owners. It does not otherwise address what non-building business
activities principals may engage in.
