The levy is set by regulation, and the existing levy regulations, which came into operation on 1 July 2008, saw a rise in the rate for category 64 and category 65 landfills from $7 to $8 a tonne on 1 July 2009. The proposed 300 per cent increase does not take effect until 1 January 2010. Any service charge collected by a council must comply with section 6.38 of the Local Government Act 1995.
