GENETICALLY MODIFIED CROPS FREE AREAS EXEMPTION ORDER 2009
I refer to the Genetically Modified Crops Free Areas Exemption Order 2009, published in the Government Gazette on 17 February 2009 and tabled in the Legislative Council on 18 March 2009 under the Genetically Modified Crops Free Areas Act 2003. In light of the disallowance motion currently before Parliament, if these canola trials are disallowed and the GM canola crops have already been planted — (1) Who will be responsible for removing the GM canola crops? (2) Who will pay for the removal of GM canola crops? (3) Who will be liable to pay compensation in the event of cross-contamination or damage to neighbouring GM-free farms? Hon ROBYN McSWEENEY

I thank the honourable member for the question. The minister has replied — (1)-(3) The question is hypothetical in nature, as the motion is yet to be debated. Therefore I am unable to provide the member with an answer.
