I refer to the May 2004 accident with a Type B gas appliance at the BHP HBI plant at Boodarie. The Minister for Energy answered my question No. 488, sub 1, on June 25 2004 in the negative, that neither the Minister or the Director of Energy Safety gave the HBI plant any special consideration, condition or exemption to provide the necessary technical approvals for the gas plant in 1996. Given that answer, I ask -
(1) Did the Director approve the HBI Type B appliances in 1996 according to the
Gas Standards Act
sections 13D, 13E or 13F?
(2) Did the Director, or an Office of Energy employed inspector designated by him for the purpose, approve the HBI Type B appliances in 1996 according to the requirements of the Gas Standards Regulations Items -
(a) item 501 (3);
(b) item 503 (2);
(c) item 525 (b); and
(d) item 729?
(3) If yes to any parts of question (2), will the Minister table these 1996 approvals?
(4) If no to any parts of question (2), how, when and to whom did the Director provide the necessary technical approvals to permit the installation of the HBI’s Type B appliances in 1996?

(2) The appliances approved in 1996 were gas turbines and the approval was for their installation as required by Clause 501(3) of the Gas Standards Regulations 1983. The Director considers that all other requirements of these regulations, as relevant, were considered at that time as part of the "approval for installation".
