I refer to correspondence between
the member for Gosnells and the Minister for Commerce in relation to Riverside
Gardens Estate.
(1) What further
action has been taken by the Consumer Protection Division to ensure legal
compliance by Hampshire Villages under the act?
(2) If no further action has been
taken, what action will Consumer Protection take in the near future?
(3) If action has been taken, what
was the result?
(4) Given recent
reports from elderly residents that they currently feel coerced into signing
waivers or new leases without adequate time or external advice, will the
minister undertake to instigate a swift, forceful and thorough investigation of
the events at Riverside Gardens Estate?
(5) If no to (4), why not?

(1) Since the
recent sale of Riverside Gardens, senior officers from the Consumer Protection
Division of the Department of Commerce have engaged and met with the chief
executive of Hampshire Villages Pty Ltd to understand its intentions and to
outline its legal obligations.
(2) Not applicable.
(3) Hampshire
Villages has acknowledged that current resident contracts remain in force and
will be honoured and has assured Consumer Protection that it is not compelling
any current resident to sign a new contract or waive their rights.
(4) Consumer
Protection continues to monitor the situation and liaise with Hampshire
Villages. Hampshire Villages has provided Consumer Protection with its draft
new lease that it intends to provide to new residents. Consumer Protection is
currently obtaining legal advice in relation to that contract. Once that
process has been completed, it intends to liaise with Hampshire Villages and
its residents to discuss any concerns.
