NICHELIVING
534. Mr R.S. LOVE to the Premier:
I
refer to the Building Services Board decision not to renew the registration of
Projex Management and Construction , trading
as Nicheliving, and advising impacted customers to contact insurance provider
QBE to discuss arrangements to access their home indemnity insurance.
(1) Is the
Premier aware that QBE is advising customers that it is unsure whether it can
proceed with settling HII claims as Nicheliving has been deregistered but has
not gone into insolvency?
(2) What action
will his government take to ensure that the hundreds of Western Australian
families left in limbo by Nicheliving are able to access home indemnity
insurance properly so they can make progress on their homes?

(1)–(2) I
thank the member for the question. My understanding is that members of the
public will be able to access that scheme as a result of the company being
deregistered. However, of course, that company has appealed the decision for
its deregistration to the State Administrative Tribunal. As a result of that,
its suspension is in abeyance until the action is completed. That is the reason
we asked the company not to appeal the decision—so we could get those
homes built as a matter of urgency. That is one of the reasons we are keen to
make sure that that situation can be resolved. It is not because we have a vendetta
against Nicheliving, but because we want to get those homes built as a matter
of urgency.
When I was the Minister for Commerce,
we doubled the value of the payouts that can take place under home indemnity
insurance because we acknowledge that escalation of costs sometimes leaves
people accessing the scheme out of pocket. We made those improvements and we
want people to be able to access that money
as soon as possible. Our priority is to get those homes built and get people
into the homes for which they entered into a contract some time ago. I regret
that Nicheliving has appealed that decision, but that is its right. I look
forward to that situation is being resolved as soon as possible so we can get
those people into their homes.
