I refer to section 10(1) of the
Forest Products Act 2000
, which empowers the Forest Products Commission (FPC) to enter into contracts for the harvesting and sale of forest products, and I ask —
(1) How many complaints has the Department of Environment and Conservation (DEC) received regarding alleged breaches of the Forest Management Plan (FMP) by FPC contractors —
(a) over the past two years; and
(b) during the life of the current FMP?
(2) How many incidents have been recorded by DEC regarding breaches of the FMP by FPC contractors —
(a) over the past two years; and
(b) during the life of the current FMP?
(3) Regarding the answer to (2), how many of these resulted in prosecutions and what was the outcome?
(4) What are the five most serious incidents relating to breaches of the FMP by FPC contractors to date?
(5) Regarding each answer to (4) —
(a) what enforcement action was taken by DEC in response;
(b) what was the outcome of that action, including but not limited to —
(i) any penalty; and
(ii) any criminal prosecution?

(1)(a)-(b) Written and verbal complaints relating to harvest operations are investigated by the Department of Environment and Conservation. Incidents found not to be compliant with timber harvesting guidance documents result in the issuing of a Management Letter (ML), Work Improvement Notice (WIN) or Incident Report (IR) to the Forest Products Commission (FPC).  The FPC administers the operations of its contractors.
(2) MLs, WINs or IRs issued as a result of actions clearly identified as attributable to a contractor are:
(a) Of the 11 incidents resulting in a WIN, ML or IR, nine incidents are attributable to FPC contractors;
(b) Of the 200 incidents resulting in a WIN, ML or IR, 142 incidents are attributable to FPC contractors.
(3) Nil
(4) The five most serious incidents related to compliance with Hygiene Management Plans.
(5) (a) A WIN or ML was issued in each case;
(b) Four incidents resulted in changes to practices, standards, or corrective measures in the field. One incident has not been resolved.
