I refer the minister to the ongoing dispute between Mr Tony Elwood and Pioneer Concrete (WA) Pty Ltd over its Red Hill quarry. I remind the minister of her commitment given in this place on 10 April last year to have Mr Elwood’s concerns fully investigated and to her commitment of 15 October last year when she said that she wanted justice for the people concerned. (1) Is the minister aware that Pioneer has allegedly been operating outside its authorised footprint area for at least the past two years? (2) Is the minister aware that the Environmental Protection Authority has advised Mr Elwood that it is reviewing only the enforceability of Pioneer’s commitments on visual impact and not the far more important issue of whether the quarry is operating outside its authorised footprint? (3) Did the minister request the EPA to report to her by 12 May, some three months ago, and will she table the EPA’s report when it is finally presented to her? Dr J.M. EDWARDS

I thank the member for the question. (1)-(3) I will perhaps work backwards. The EPA report to me will be in the form of a section 46 review, so it will be a bulletin that will be advertised in the EPA notices on a Monday when it is available. I expect it very shortly. The EPA has told me that it is working on it and is nearly finished. Therefore, I anticipate seeing that soon, and it will be in the public arena. On the other issues, section 46 addresses the ministerial conditions attached to that project, so the EPA is looking at that. With regard to the member’s first question, that matter has been, or is still being, investigated by the department to see what can be done about compliance.
