I refer to the instrument of delegation 2009/04, of the delegation of certain powers and functions of the Western Australian Planning Commission and ask: (a) can the Minister guarantee that all decisions made by delegation under this instrument were made in strict compliance with the applicable local planning scheme; and (b) has an audit been undertaken of all decisions made under this delegation since 2009?

(a) I have confidence that the Western Australian Commission takes its powers of delegation seriously.  I understand that under the delegation instrument 2009/04 the delegation is contingent on a decision being made in strict compliance with the applicable local planning scheme. The Commission expects officers, including officers in other departments exercising delegated authority, to use their powers in good faith, utilising all due care and expertise.
(b) Instrument 2009/04 requires officers of the Department of Housing to provide monthly reports on decisions to the Commission.
