Conservation and Land Management Act 1984
(the Act), and ask -

(1) In the performance of functions under the
Conservation and Land Management Act 1984
(CALM Act), the CEO of the Department of Environment and Conservation is subject to the direction and control of the Minister. The Conservation Commission of Western Australia and the Marine Parks and Reserves Authority (MPRA) have a function, respectively, of developing policies to achieve or promote the objectives of management plans for lands and waters for which they are responsible. The CEO of DEC also has a role in determining and setting policy, subject to the direction and control of the Minister.
(2) All management plans by which DEC must operate when managing lands and waters are approved by the Minister in accordance with section 60 of the CALM Act. The CALM Act stipulates that management plans are prepared by the Conservation Commission or the MPRA through the agency of the CEO of DEC, and that the Commission and the MPRA, respectively, monitor and assess the implementation of management plans by DEC.
(3) The membership of the Conservation Commission meets the requirements of section 21(3) and (4) of the CALM Act. The Commission does not have an operational land management role and there is no requirement in the CALM Act for the membership to include experience and expertise specifically in fire management.
