On behalf of the Minister for Housing and Works I provide the following response - (1)-(3) The Government is preparing legislation to implement its election commitment to provide greater security of tenure for people who live in residential caravan parks. Cabinet has approved the drafting of relevant legislation to regulate the relationship between proprietors of residential parks and those tenants for whom the residential park is their principal place of residence. The minister will be seeking a priority for the drafting of the Bill, which will ensure that it is ready to be introduced to Parliament during the spring 2004 session. He is keen to see the Bill’s passage before the dissolution of Parliament for the election. Issues arising in the Lake Joondalup Lifestyle Village matter, including the nature of the proprietary interest of residents, their security of tenure and the specific provisions of their lease agreements, are being addressed in the negotiations by the Department of Consumer and Employment Protection with the developer to obtain new lease agreements for residents. The issues that have arisen in this matter will be considered in the course of drafting the new legislation. However, to some extent the issues arose simply due to a failure to provide a valid lease agreement rather than highlighting a particular gap in existing legislation.
