ENVIRONMENTAL IMPACT ASSESSMENTS — COMPLIANCE REVIEW
I refer to approvals under part IV, “Environmental Impact Assessment”, of the Environmental Protection Act 1986. I refer also to question without notice 61 of yesterday, 22 February. (1) Has the general manager of the Office of the Environmental Protection Authority recently received a report of an audit or review about compliance of the implementation of projects with conditions set in the approval documents? (2) If yes to (1) — (a) who conducted the review or audit; (b) what was the outcome of the review or audit; (c) what percentage of projects has been found to be noncompliant with one or more of their conditions; and (d) is the office concerned about the outcome of the review? (3) If no to (1), how is the EPA monitoring compliance with conditions set in approval documents? (4) According to what criteria does the EPA identify a possible significant noncompliance that warrants immediate reporting to the minister? Hon HELEN MORTON

(1) No. The general manager of the Office of the Environmental Protection Authority has not recently received a report of an audit or review about the overall compliance of the implementation of projects with implementation conditions set in the approval documents. However, the majority of ministerial statements require proponents to review and report compliance with implementation conditions of the ministerial statements generally on an annual basis to the OEPA. (2) Not applicable. (3) The OEPA monitors compliance through receiving and reviewing compliance reports and conducting its own desktop audits and verification inspections. (4) The OEPA uses its discretion in determining whether a noncompliance warrants immediate reporting to the minister.
